Terms and Conditions

The Swift Marketer LLC. Last updated 6 October 2026.

Who we are and what these terms cover

These terms apply to your use of theswiftmarketer.com and to the services provided by The Swift Marketer LLC, a limited liability company registered in Sheridan, Wyoming, USA. In these terms, "we", "us" and "our" mean The Swift Marketer LLC, and "you" means the person or business using our website or our services.

By using our website, downloading a resource, booking a call, or engaging us for services, you agree to these terms. If you are agreeing on behalf of a business, you confirm you have the authority to do so.

Where we provide services to you, the specific scope, fees, timelines and deliverables are set out in the proposal, order form, invoice or agreement we send you (the "Service Agreement"). If anything in a Service Agreement conflicts with these terms, the Service Agreement applies to that engagement.

Using our website

Our website is provided for information about our services and for general marketing education. You may browse it, download the resources we offer for your own business use, and contact us through it.

You may not copy, resell or redistribute our content, templates or resources, use the website in a way that damages it or interferes with others using it, attempt to gain unauthorised access to any part of it, or use automated tools to scrape or harvest content or data from it.

We may change, suspend or remove any part of the website at any time without notice.

Our services

We provide marketing services including paid advertising management, funnel and landing page design, email marketing, lead generation and follow up systems, social media management, content production, influencer marketing, and related automation and reporting. The services you receive, and the fees for them, are those set out in your Service Agreement.

We will perform the services with reasonable skill and care, and in line with the practices of the advertising platforms and tools involved. Where we need access to your accounts, platforms or data to do the work, you agree to provide it promptly and to keep that access in place for the length of the engagement.

Your responsibilities

To deliver the services, we rely on you to:

  • Give us accurate information about your business, products, pricing and offers, and tell us promptly if anything changes.
  • Provide access to the accounts, platforms, assets and people we need in order to do the work.
  • Review and approve work within the timeframes set out in your Service Agreement. If approvals are delayed, timelines move accordingly.
  • Make sure your products, services, claims and content comply with the law and with the policies of the advertising platforms we use on your behalf.
  • Fund your own advertising spend. Unless your Service Agreement says otherwise, ad spend is paid by you directly to the advertising platforms and is separate from our fees.

Fees and payment

Our fees, payment schedule and payment methods are set out in your Service Agreement or invoice. Fees are quoted exclusive of any applicable taxes unless stated otherwise. Where a fee is payable before work begins, we will not start until it has been received.

If an invoice is not paid by its due date, we may pause work until payment is made, and timelines will move accordingly. Our fees are separate from and do not include advertising spend, software subscriptions, creator fees or other third party costs unless your Service Agreement says they do.

Term, cancellation and refunds

Ongoing services run for the term set out in your Service Agreement, and either party may end them by giving the notice period stated there. One off projects end when the agreed deliverables have been provided.

Fees already paid for work that has been delivered are not refundable. Any guarantee we offer, including our Profitable Campaign Guarantee for eligible engagements, applies only as described in the Service Agreement for that engagement, and is subject to the conditions stated there, including proof of concept for the product and your continued cooperation and funding of ad spend.

Results and no guarantee of outcome

Marketing results depend on many factors outside our control, including your product, pricing, market, competitors, website, fulfilment and the behaviour of advertising platforms. Figures we show on our website are real results from accounts we have worked on. They show what has happened for other clients and are not a promise of what will happen for you. Except where a written guarantee in your Service Agreement says otherwise, we do not guarantee any particular level of leads, sales, return on ad spend or revenue.

Intellectual property

You own your brand, your products, your customer data and any materials you give us. Once the fees for an engagement have been paid in full, you own the final deliverables we create for you, such as ad creative, landing pages, emails and content, except for any third party material, stock assets or software that is licensed rather than owned.

We keep ownership of our methods, processes, templates, frameworks and any tools or systems we use or develop to deliver the services. You may not resell or sublicense them. We may describe our work for you, including anonymised results, in our marketing. We will not name you or show your brand without your permission.

Confidentiality

Each of us will keep the other's confidential information private, use it only for the purposes of the engagement, and not disclose it to anyone who does not need it, except where the law requires. This includes your business data, account access and performance figures, and our pricing, methods and internal processes. This obligation continues after the engagement ends.

Content, creators and influencers

Where we produce content or manage creator and influencer campaigns for you, we will agree the brief, deliverables and usage rights with you in writing before work starts. Usage rights for creator content are those agreed with the creator and set out in your Service Agreement. You are responsible for ensuring your products can lawfully be promoted in the way requested, and that any required disclosures, such as paid partnership labels, are made.

Third party platforms and tools

Our services depend on platforms and tools owned by others, including Meta, Google, TikTok, LinkedIn, email providers, hosting and automation tools. We do not control them. We are not responsible for their outages, policy changes, account restrictions or disapprovals, though we will work with you to resolve them where we can. Your use of those platforms is subject to their own terms.

Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

Subject to that, we are not liable for indirect or consequential loss, lost profit, lost revenue, lost data, or lost business opportunity, however it arises. Our total liability to you in connection with any engagement is limited to the fees you have paid us for that engagement in the three months before the event giving rise to the claim. This limit does not apply to advertising spend, which is paid by you directly to the platforms.

Suspension and termination for cause

We may suspend or end the services immediately if you breach these terms or your Service Agreement and do not fix the breach within 14 days of us telling you, if you fail to pay fees when due, or if you ask us to do anything unlawful or against the policies of the platforms we use. You may end the services immediately if we materially breach these terms and do not fix the breach within 14 days of you telling us.

Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last changed. Changes apply to website use from the date they are posted. For existing engagements, the terms in place when your Service Agreement was signed continue to apply unless we agree otherwise in writing.

Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. If a dispute arises, we both agree to try to resolve it by discussion first. If that does not work, the courts of Wyoming have exclusive jurisdiction, unless your Service Agreement states otherwise. Nothing in this section takes away rights you have under the consumer protection laws of the country where you live, where those laws apply to you.
